Hassan Zein- Plaintiff

An Accra High Court, presided over by Justice Kwasi Agyenim Boateng, has adopted the terms of settlement reached between a Ghanaian businessman, Hassan Zein and a musician, Kwame Asare Obeng, popularly known as A-Plus.

Consequently, A-Plus has been ordered to retract and apologize to Zein, the plaintiff, of the defamatory publication he made against him, using the same medium he used to defame the entrepreneur and global investor.

Meanwhile, the following are the terms of settlement adopted by the court;

CONSENT JUDGMENT BY COURT:

These Terms filed by the parties on 29th January, 2024 are hereby adopted as Consent Judgment of the Court between the Plaintiff and the Defendant.

TERMS OF SETTLEMENT

These Terms of Settlement are agreed and entered into by the PLAINTIFF and DEFENDANT in order to resolve the claims of the Plaintiff against the Defendant in this matter.

WHERE AS The Plaintiff issued a Writ of Summons and Statement of Claim against the Defendant claiming as follows:

  1. A declaration that the Defendant has defamed the Plaintiff’s reputation.
  2. General damages of Ten Million Ghana Cedis (GH¢10,000.000.00) in respect of relief “a” above.
  3. An order direct at the Defendant to retract the said defamatory comment and picture of the Plaintiff through the same medium used in defaming the Plaintiff.
  4. An order directed at Defendant to apologise within seven (7) days to the Plaintiff using the same medium used to commit the act of defamation.
  5. Perpetual injunction against the Defendant from ever defaming the Plaintiff’s reputation.
  6. An order for the payment of exemplary and punitive damages.
  7. Any other orders as the Honourable Court may deem most appropriate including costs.
  8. Any other orders as the Honourable court may deem most appropriate including costs.

IN SETTLEMENT THEREFORE THE PARTIES AGREE AS FOLLOWS:

That the Defendant agrees to retract the comment and picture of the Plaintiff through the same medium same was posted on.

That the Defendant also agrees to apologise to Plaintiff through the same medium the comment was posted on.

That the Defendant agrees to pay a cost of One Hundred Thousand Cedis (GHe100.000.00) to the Plaintiff.

That these terms shall constitute the entire understanding of the parties and completely extinguish the rights, obligations and claims of the parties arising from the subject matter of this suit. No order as to cost.
